or to one or more factors specific to the physical, physiological, genetic,
mental, economic, cultural or social identity of that individual.
• “Services”: the services

Tourist information,
Monegasque news,
The online chat form,
Download of online documents and brochures.
• Website”: this

• “User” or “You”: any
individual or legal entity using the Visitmonaco website and accessing the Services
provided by the Visitmonaco website.
2) - Purpose of the Visitmonaco Website
The Visitmonaco Website is intended to provide
tourist information, and to promote the Destination through various articles
and online blogs.
3) - Access to the Website
You access the Visitmonaco website at your own
discretion and at your own cost. In order to access and browse the Website, You
must have a sufficiently fast internet configuration and hardware.
The Administration cannot be held liable in the
event that the Services do not operate correctly, in the event that a
malfunction occurs or internet access is restricted or degraded.
The Services may be accessed freely and securely via the following URL https://visitmonaco.com
In the event that the Services are suspended or
unavailable, You may contact the Administration for information.
The Services must not be used in an improper or
malicious manner.
Generally,
You undertake to use the Services:
- in accordance with laws, regulations and third party rights, in particular the Administration’s intellectual property rights as defined in the section of these terms of use concerning intellectual property;
- fairly and in accordance with their intended purpose;
- at your exclusive liability.
You may
not fraudulently access or remain in any part of the Visitmonaco Website,
delete or change data contained on the Visitmonaco Website, fraudulently place
data on the Visitmonaco Website, or alter the Visitmonaco or disturb its proper

a) Copyright
All rights attached to any content published on
this website are the exclusive property of the Administration, unless
specifically attributed to a third party. This includes, but is not limited to,
all texts, comments, titles, names, photographs, sounds, images, data,
drawings, animated sequences with sound, videos, functionalities and charts,
which are protected by copyright law applicable in the Principality of Monaco.
Any use, representation, transformation,
reproduction, adaptation or dissemination, in whole or in part, of any element
or content from this Website on any media and via any procedure is prohibited
and constitutes a criminal offence prosecuted by the Monaco courts, unless
express permission is obtained from the Administration.
b)Trademarks
Marks and/or logos owned by the Administration
and appearing on this Website are protected by statutory provisions applicable
in Monaco. Reproducing such marks and/or logos, either wholly or partially,
without the permission of the owner, constitutes a criminal offence prosecuted
by the courts of Monaco.
5) - Liability
You acknowledge and
agree that the Administration may not be held liable for the Visitmonaco
Website and Services, notably in the event of intrusion, alteration, theft of
data, or any use by a third party, which is illegal or causes prejudice to You
or to a third party. If You wish to inform the Administration of a mistake or

or implied, regarding the operation of this website and may not under any
circumstances be held liable for any damage, whether direct or indirect,
commercial or otherwise, or consequences that may result from an erroneous or

The Administration will endeavour to ensure
that the information published on this Website remains accurate and up-to-date,
but accepts no liability for any use made of information featured on the
Visitmonaco Website.
The Administration does not guarantee the
continuity, accessibility or availability of the operation of this Website and
the associated services.

6) - Personal data protection
In accordance with applicable regulations on
the protection of personal data, information obtained through the Visitmonaco
Website is collected by the State of Monaco / Tourist and Convention Authority
(2, rue de la Lüjerneta – 98000 MONACO), hereinafter referred to as “the
Administration”, which acts as data controller.
Personal Data are processed for the purposes of
“Managing the Visitmonaco website”, which are as follows:
- Allowing browsing (cookies);
- Allowing persons to contact the Administration and referenced partners;
- Allowing users to communicate online with our hosts and to upload requests for information (form);
- Allowing the dissemination of tourist information (blogs, articles, etc.) ;
- Establishing statistics (Analytics).
The processing activity “Managing the
Visitmonaco Website” forms part of the roles carried out by the Administration
(DTC). It is justified by:
- The consent of the person concerned;
- The pursuit of legitimate interests by the Administration: to enable the Administration to promote the destination and publish tourist information.
This information is retained only for as long
as necessary for the aforementioned purposes, and notably:
- In the case of cookies: 13 months maximum.
- The data processed as part of the Visitmonaco Website’s services and features is intended for the Administration only, and is not passed to third parties for commercial or advertising reasons.
Recipients of Personal Data are:
- Specially authorised personnel of the Administration, which operates the Visitmonaco website;
- Authorised personnel of the “chat” provider when submitting the information request form.
Audience measurement cookies cause technical
data (e.g. IP address) to be sent to the United States, a country which does

The Administration may not be held responsible
for any damage or loss that may result from or be connected with the use of
these external websites. Users of this Website use such third-party websites at
their own liability and risks. The Administration accepts no liability
whatsoever.

8) - Jurisdiction
All
disputes relating to the use of the Visitmonaco Website are subject to the laws
of Monaco and the exclusive jurisdiction of the courts of Monaco.
II) Purpose and processing of CRM data
1) - Presentation :
The
Tourist and Convention Authority uses a CRM to centralise tourist data such as
contacts and events (Leisure, Business Tourism, Press, etc.). As part of its
role, the Tourist and Convention Authority is required to promote Monaco as a
destination, and facilitate the organisation of events in the Principality.
Purpose: Promoting Monaco as a
destination
Functions: Managing contacts, Managing
tourism operations, Managing hotel room nights by period and sector, Storing
data on cruise stopovers, Managing travel and hospitality expenses managed by
the Tourist and Convention Authority.
2) - Personal data
In the
course of its work, the Tourist and Convention Authority collects personal
data. The contact is informed that, pursuant to Act no. 1.165 of 23 December
1993 (amended) on the protection of personal data, information provided by the
user is required in order to respond to their query, and is intended for the
Tourist and Convention Authority (the data controller) for administrative and
promotional purposes. Certain information will be shared with our
representative offices and tourism partners (including those in countries
without adequate protections: Australia, China, Singapore, Brazil, India,
United States, Russia, Japan, Asia), then deleted after five years of
inactivity.
